1. Who these terms cover

These terms apply to any organization ("you") that books a fundraising event with ZingerZ Fundraising ("we", "us"), based in Pantego, Texas. We are the fundraising arm of ZingerZ Comedy Club. Your signed event agreement and these terms together form the whole arrangement. If the two differ, your signed agreement wins.

2. Booking and deposit

A $500 deposit reserves your date. It is non-refundable, but you do not lose it if you postpone. It carries over to your new date, subject to availability. Your date is not held until the deposit arrives. A no-deposit option may be available for some groups and dates. Just ask.

3. Fees and the profit split

Event proceeds split 50/50 on the first $2,000 raised: $1,000 to your organization and $1,000 to us. Our event fee is capped at $1,000. After $2,000, your organization keeps 100% of everything else.

Your organization keeps a minimum of 50% of all funds raised, whatever the total. This guarantee applies to the fundraiser fee only and does not include additional expenses such as long-distance travel, which are covered separately under section 4. Card processing on the online ticket store is 5% plus $0.75 per ticket. You may pass that to ticket buyers or absorb it.

4. Travel and long-distance events

For events located more than approximately three hours' driving time from the Dallas–Fort Worth market, a separate travel fee applies in addition to the deposit and the event fee. The travel fee is quoted to you in writing before you book. It covers vehicle and mileage, lodging where an overnight stay is required, crew meals while away, and the additional crew day a long-distance date requires. Air travel, where appropriate, is quoted case by case.

The travel fee sits outside the fundraiser fee and outside the 50% profit guarantee. It is a reimbursed cost rather than a share of proceeds, and it is not deducted from event proceeds.

The travel fee and the $500 deposit must both be paid in full before the event date. We are not obliged to travel to or perform at an event where either amount remains outstanding on the day of the event.

Once paid, travel fees and any other pre-paid event costs are non-refundable. If the event is canceled or rescheduled after those costs have been paid, they are retained in full, because the associated bookings, supplier commitments and crew dates have already been made and are not recoverable.

Where an event is rescheduled, the deposit carries over to the new date but the travel fee does not. Travel for the new date is quoted and paid again.

If we are unable to perform for reasons within our control, the travel fee is refunded in full. If an event cannot proceed for reasons outside the control of either party, we refund any portion of the travel fee we are able to recover from suppliers and retain the remainder.

5. What we provide

• Professional performers, host, emcee and auctioneer for your event
• An online ticketing store set up for your event
• A digital flyer and a Facebook event page
• A step-by-step fundraiser guide and promotional guidance
• Regular check-ins from booking through to show night

6. What you provide

• A suitable venue with a stage or stage area, and any associated venue costs
• Ticket sales and promotion to your community. We provide the tools and coaching, and you know your people
• Raffle and auction items, and volunteers to run the tables
• Any food, drink, décor or additional entertainment you choose to add
• Any permits, licenses, or insurance your venue or jurisdiction requires

7. Content and audience rating

We perform clean comedy. Before your event you pick a rating: Family-Friendly, Clean, or PG-13. We perform to that standard. The show is improvised from audience suggestions, so exact material cannot be previewed. We do not accept bookings for politically motivated causes.

8. Rescheduling and cancellation

Need to move your date? Tell us as early as you can and we will apply your deposit to the new date, subject to availability. If you cancel outright, the deposit is not refunded. Any proceeds already collected are settled using the split above. Travel fees and other pre-paid event costs are non-refundable on both cancellation and rescheduling, as set out in section 4.

Sometimes things happen that are outside our control: severe weather, illness, a venue failure. If we cannot perform, we will first offer a replacement date. If no replacement date works, we refund your deposit, and we refund any travel fee to the extent set out in section 4.

9. Payment of proceeds

We reconcile online ticket store funds after your event. Your share is paid out, less the event fee and processing costs above. Cash and checks you collect on the night stay with you and count toward the reconciliation.

10. Photography and media

We may photograph or record parts of the event for promotional use. We may also use your organization's name and results in our marketing. Tell us in writing beforehand if you would rather we did not, and we will respect that.

11. Liability

We are responsible for delivering the performance and services in your agreement. We are not responsible for the venue, attendee conduct, or items donated to your raffle or auction. We are also not responsible for how much your event raises beyond the guaranteed minimum above. Nothing here limits liability that cannot lawfully be limited.

12. Governing law

These terms are governed by the laws of the State of Texas.
